1. Agreement to Terms

These Terms and Conditions ("Terms," "Agreement") constitute a legally binding agreement between you ("User," "you," or "your") and SWPPP Hub ("Company," "we," "us," or "our"), the owner and operator of www.swppphub.com (the "Site"). By accessing, browsing, or submitting any form on this Site, you acknowledge that you have read, understood, and agree to be bound by these Terms. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST IMMEDIATELY CEASE USE OF THIS SITE.

We reserve the right to modify these Terms at any time. Changes are effective immediately upon posting. Your continued use of the Site after any changes constitutes your acceptance of the revised Terms.


2. Nature of the Site — Lead Generation and Referral Platform

2.1 Site is a Lead Generation Platform

SWPPP Hub is a lead generation and referral platform only. The Site is designed to connect individuals and organizations requiring Stormwater Pollution Prevention Plan (SWPPP) consulting, NPDES permit compliance, Best Management Practices (BMP) planning, industrial stormwater permitting, construction general permit (CGP) compliance, and related environmental services ("Environmental Services") with independent, third-party licensed environmental consultants, engineers, or compliance specialists ("Service Partners" or "Contractors").

2.2 SWPPP Hub is NOT a Licensed Environmental Consulting Firm

SWPPP Hub does not provide environmental consulting services, engineering services, legal advice, or regulatory compliance advice. We do not prepare SWPPPs, file NOIs, conduct site inspections, or offer professional opinions on stormwater compliance. Nothing on this Site constitutes professional engineering, environmental consulting, or legal advice.

2.3 No Contractor-Client Relationship

Your submission of a form or inquiry on this Site does not create any contractor-client, consultant-client, attorney-client, or fiduciary relationship between you and SWPPP Hub. Any such relationship, if established, will be solely between you and the independent Service Partner you ultimately engage.

2.4 No Guarantee of Service or Contact

Submission of an inquiry does not guarantee that you will receive a response, quote, or connection to a Service Partner. SWPPP Hub does not guarantee availability of Service Partners in your area or for your project type.


3. Consent to Be Contacted

BY SUBMITTING ANY FORM ON THIS SITE, YOU EXPRESSLY AGREE AND CONSENT TO:

  • Being contacted by SWPPP Hub and/or its Service Partners via telephone (including cellular), email, and/or SMS text message, including via automated dialing technology or prerecorded voice messages, regarding your inquiry and related environmental compliance services;
  • Such contact even if your phone number appears on a state or national Do-Not-Call registry;
  • The sharing of your submitted contact information and project details with one or more third-party Service Partners.

This consent is given pursuant to the Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227, and applicable state regulations. Consent is not a condition of purchase. Message and data rates may apply. You may revoke consent at any time by contacting us at legal@swppphub.com or by using any opt-out mechanism provided in communications.


4. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SWPPP HUB EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Accuracy of Information: We make no representations or warranties that the content on this Site is accurate, complete, current, or error-free. Environmental regulations vary by state, local jurisdiction, and project type and change frequently. Information on this Site may not reflect the most current regulatory requirements.
  • Fitness for a Particular Purpose: Content and referrals on this Site are provided for general informational and referral purposes only and may not be suitable for your specific project, site conditions, or regulatory jurisdiction.
  • Quality of Service Partners: We make no warranties, express or implied, regarding the qualifications, licensure, insurance, competence, integrity, or performance of any Service Partner referred through this Site. Stormwater regulations under the Clean Water Act, 33 U.S.C. § 1251 et seq., and applicable state laws are complex and highly site-specific.

SWPPP requirements, permit thresholds, and compliance obligations vary by:

5.4 Enforcement and Penalty Disclaimer

Failure to comply with SWPPP, NPDES, or stormwater requirements may result in significant civil or criminal penalties under federal and state law. SWPPP Hub expressly disclaims any liability for regulatory enforcement actions, fines, penalties, permit violations, or compliance failures of any user or entity that accessed this Site.


6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

6.1 IN NO EVENT SHALL SWPPP HUB, ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO:

  • Your use of, or inability to use, this Site;
  • Any information obtained from this Site;
  • Any services provided by, or failure of, a Service Partner referred through this Site;
  • Any regulatory non-compliance, enforcement action, or permit violation;
  • Any errors, omissions, or inaccuracies in Site content;
  • Unauthorized access to your data or submissions.

6.2 THIS LIMITATION APPLIES WHETHER THE CLAIM IS BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF SWPPP HUB HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

6.3 TOTAL AGGREGATE LIABILITY: In jurisdictions that do not allow the complete exclusion of liability, SWPPP Hub's total liability to you for all claims arising from your use of this Site shall not exceed fifty U.S. dollars (US $50.00).


7. Indemnification

You agree to indemnify, defend, and hold harmless SWPPP Hub, its owners, officers, employees, agents, and Service Partners from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the Site or any Service Partner's services;
  • Your violation of these Terms;
  • Your violation of any applicable law or regulation, including environmental regulations;
  • Any claim by a third party arising from information you submitted to the Site;
  • Any inaccurate or misleading information you provided in any form submission.

8. Third-Party Service Partners

8.1 Independent Contractors

Service Partners referred through this Site are independent contractors. They are not employees, agents, joint venture partners, or representatives of SWPPP Hub. SWPPP Hub has no control over, and expressly disclaims responsibility for, the actions, omissions, advice, quality of work, regulatory compliance, professional licensure, insurance coverage, or billing practices of any Service Partner.

8.2 Due Diligence is Your Responsibility

Before engaging any Service Partner, you are solely responsible for:

  • Verifying their professional licenses and certifications in your state
  • Confirming their insurance (E&O, general liability, etc.)
  • Reviewing their qualifications for your specific project
  • Negotiating and executing a separate service agreement directly with them

8.3 Disputes with Service Partners

Any dispute you have with a Service Partner is between you and that Service Partner only. SWPPP Hub will not mediate, arbitrate, or be held liable in any dispute between you and a Service Partner.


9. Intellectual Property

All content on this Site, including but not limited to text, graphics, logos, icons, images, and software, is the property of SWPPP Hub or its content licensors and is protected by U.S. and international copyright, trademark, and intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any content from this Site without our express written permission.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal, non-commercial use only.


10. Prohibited Uses

You agree not to use the Site to:

  • Submit false, misleading, or fraudulent inquiry information
  • Harvest or scrape contact information or leads
  • Reverse-engineer, copy, or replicate the Site's structure, content, or SEO strategy
  • Circumvent any Site security measures
  • Transmit spam, malware, or unsolicited communications
  • Violate any applicable local, state, federal, or international law
  • Infringe on the intellectual property rights of SWPPP Hub or any third party
  • Impersonate any person or entity

We reserve the right to terminate or restrict your access to the Site at our sole discretion, without notice, for any violation of these Terms.

10.2 Suspension, Restriction, and Termination

We may suspend, restrict, or terminate your access to the website and any related services, in whole or in part, at any time and in our sole discretion, including where we believe you have violated these Terms, engaged in unlawful or abusive conduct, or otherwise acted in a manner we consider harmful or objectionable, and in all cases only to the extent permitted by applicable law.


11. Governing Law and Dispute Resolution

11.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New Mexico, without regard to its conflict of law provisions.

11.2 Informal Resolution

Before initiating any formal legal proceeding, you agree to first contact us at legal@swppphub.com and attempt to resolve the dispute informally for a period of at least 30 days.

11.3 Binding Arbitration

If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. YOU WAIVE YOUR RIGHT TO A JURY TRIAL AND YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

11.4 Exceptions

Notwithstanding the above, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm, including infringement of intellectual property rights.

11.5 Venue

For any matters not subject to arbitration, you agree to submit to the exclusive personal jurisdiction of the state and federal courts located in Bernalillo County, New Mexico.


12. Privacy Policy

Your use of the Site is also governed by our Privacy Policy, available at www.swppphub.com/privacy-policy, which is incorporated into these Terms by reference.


13. Entire Agreement / Severability

These Terms, together with the Privacy Policy, constitute the entire agreement between you and SWPPP Hub regarding your use of the Site. If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.


14. No Waiver

Our failure to enforce any right or provision of these Terms shall not be considered a waiver of those rights. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of SWPPP Hub.
