What Is a SWPPP?
A Stormwater Pollution Prevention Plan -- universally shortened to SWPPP (pronounced "swip-ee") -- is a site-specific written document that describes how a construction project will prevent stormwater pollution during land-disturbing activities. It is required by federal law for any construction project that disturbs one acre or more of land and is the foundational compliance document for the EPA's National Pollutant Discharge Elimination System (NPDES) Construction General Permit (CGP).
In plain terms: whenever construction stirs up soil, stormwater can carry that sediment, construction chemicals, concrete washout, fuels, and other pollutants into nearby streams, rivers, lakes, and groundwater. The SWPPP is the operator's written commitment that specific practices -- called Best Management Practices (BMPs) -- will be installed and maintained to prevent that from happening.
The Clean Water Act (Section 402) and EPA regulations at 40 CFR Part 122 establish the SWPPP requirement at the federal level. Most states that operate their own delegated NPDES programs -- including New Mexico (NMPDES), Arizona (AZPDES), and Texas (TPDES) -- have adopted SWPPP requirements that are at least as stringent as the federal standard and often more detailed.
Who Needs a SWPPP?
You need a SWPPP if you are an operator of a construction site that:
- Disturbs 1 acre or more of land (grading, clearing, excavating, stockpiling, demolition with earthwork)
- Disturbs less than 1 acre but is part of a larger common plan of development that will ultimately disturb 1+ acres
- Is located within a quarter mile of a water of the U.S. in some states (check state-specific thresholds)
- Involves industrial activity at the construction site (concrete batch plants, asphalt plants, material processing) -- these may require coverage under both the CGP and the Multi-Sector General Permit (MSGP)
Who counts as an "operator"? This is broader than most people realize. An operator is anyone with operational control over construction plans and specifications, OR day-to-day operational control over construction activities. In practice, this typically means:
- The project owner (always)
- The general contractor (almost always)
- Major subcontractors performing significant earth disturbance (sometimes)
Multiple parties at one site can -- and often do -- hold NPDES permit obligations simultaneously. Coordination of shared SWPPP responsibilities is a common compliance gap that leads to enforcement action.
What Must Be in a SWPPP?
The EPA CGP and most state CGPs specify the required content. At minimum, a compliant SWPPP must contain:
1. Site Description
- Project name, location (legal description and GPS coordinates)
- Acreage of total site and acreage of disturbance
- Construction activity description and sequence
- Receiving water name(s) -- the stream, river, lake, or conveyance that site runoff ultimately reaches
- Whether receiving water is listed as impaired (303(d) list)
- Soil type, topography, and drainage patterns
2. Pollutant Source Identification
A systematic inventory of every area and activity on site that could generate pollutants in stormwater:
- Disturbed soil areas (erosion source)
- Stockpiles (sediment and chemical runoff)
- Concrete washout areas (high pH water)
- Fueling and vehicle maintenance areas (hydrocarbons)
- Chemical storage areas
- Dewatering operations
- Waste management areas
3. BMP Selection and Design
For each pollutant source, the SWPPP must describe the specific BMPs that will control or eliminate the pollution risk. BMPs fall into two main categories:
Erosion Control BMPs -- Minimize soil exposure and stabilize disturbed areas:
- Temporary seeding and mulching
- Erosion control blankets and matting
- Silt fence (perimeter control)
- Compost sock and fiber log berms
- Phased grading to minimize exposure duration
- Construction road stabilization (aggregate or geotextile)
Sediment Control BMPs -- Capture sediment that does erode before it leaves the site:
- Sediment basins and traps
- Inlet protection (silt sacks, filter media)
- Check dams in drainage channels
- Perimeter controls (silt fence, wattles)
- Concrete washout facilities
- Vehicle tracking pads
4. Site Map
A scaled or dimensioned site plan showing:
- Site boundaries and disturbed areas
- Location of all BMPs
- Drainage patterns and conveyances
- Receiving waters within the site vicinity
- Location of material and waste storage areas
- Construction entrance locations
5. Inspection and Maintenance Schedule
- Inspection frequency (at minimum: every 14 days and within 24 hours of a 0.5-inch precipitation event under the federal CGP; more frequent under some state CGPs)
- Who will conduct inspections (name and qualification)
- How inspection findings will be documented
- How BMP repairs and corrective actions will be completed and documented
6. Corrective Action Procedures
Steps to be taken when a BMP fails, a discharge occurs, or an inspection identifies a deficiency. Response timelines vary: some repairs must be initiated within 24 hours, completed within 7 days.
7. Training and Subcontractor Documentation
Evidence that all personnel performing work covered by the SWPPP have received training on the plan's requirements. Many state permits require this documentation before subcontractors begin earth-disturbing work.
8. Certification
The SWPPP must be certified and signed by a responsible corporate officer of the permit operator. This is a legally significant signature -- the certifier attests under penalty of law that the plan is accurate and complete.
How Does a SWPPP Work With the NOI Process?
The SWPPP and the Notice of Intent (NOI) are two different but interdependent documents:
- The NOI is the application you file with the permitting authority (EPA or state agency) to obtain coverage under the Construction General Permit. It tells the agency who you are, where the project is, and when you plan to start.
- The SWPPP is the site-specific compliance plan that you develop before filing the NOI in most states.
You must have the SWPPP completed and ready before you submit your NOI -- not after you receive permit coverage. The NOI certifies that a SWPPP is in place; the agency does not review or approve the SWPPP before issuing coverage.
This is a critical compliance point: many operators assume SWPPP development happens after permit approval. It does not.
How Long Does a SWPPP Stay in Effect?
A SWPPP is a living document -- it stays in effect for the entire duration of construction, from the first land disturbance to the filing of the Notice of Termination (NOT). The NOT is filed when:
- All construction activity is complete
- All disturbed areas have achieved final stabilization (perennial vegetative cover, permanent hardscape, or equivalent)
- All temporary BMPs have been removed
- There is no further potential for pollutant discharge
The SWPPP must be amended whenever site conditions change materially: new areas are disturbed, a BMP fails and is replaced with a different type, drainage patterns change due to grading, or a new subcontractor with earth-disturbing scope is added.
Some operators treat the SWPPP as a one-time document prepared at the start of the project. This is a compliance failure. The SWPPP must reflect current site conditions at all times.
Common SWPPP Mistakes That Lead to Enforcement
- No SWPPP at all -- most common on smaller sites (1-3 acres) where the operator did not realize coverage was required
- SWPPP not on site -- plan is in the office, not the job trailer; inspector arrives and there is nothing to show
- SWPPP not updated -- plan reflects initial site conditions but not current drainage patterns or BMP locations
- Missed post-storm inspection -- rain event overnight, no one checks the site, no documentation; this is the most frequently cited CGP violation
- BMP not installed -- plan says silt fence around the perimeter, grading crew has not installed it yet
- No NOT filed -- project is done, site is stabilized, but permit coverage was never terminated
SWPPP vs. SPCC: What's the Difference?
